pursuant to art.13 of Legislative Decree no. 196 of 30.6.2003 (Privacy Code) we wish to inform you that your personal data, including your email address, which you will spontaneously send to the email addresses: info@chicandclick.com or through one of the forms on this site, will be processed by Star S.r.l. in compliance with the aforementioned legislation.
According to the provisions of Legislative Decree no. 196/2003, data processing is carried out in compliance with the principles of correctness, lawfulness, transparency and protection of your privacy and your rights. Star S.r.l. wishes to inform the User of the following:
The User's personal data provided during commercial relationships and/or for the performance of promotional activities or in the formation of contractual relationships, will be processed:
a) for purposes functional to the fulfillment of fiscal, accounting and legal obligations; for the purpose of merely exchanging information and contacts of a commercial nature or for the management of pre-contractual negotiations in function of a possible request by the User to use the offers of Star S.r.l.; for the purpose of fulfilling the obligations arising from contracts stipulated with customers; for the supply of products and accessories, assistance, replacement, repairs including after-sales; customer management and administration, orders, shipments, issuing invoices, solvency control;
b) for purposes related to commercial activity (marketing and advertising, promotional activities and information on future commercial initiatives, innovation of the services offered);
The data communicated by the User may be communicated to tax consultants and banks for the management of collections and payments arising from the execution of the authorized contract.
The data may also be communicated, following inspections or checks, to the bodies responsible for verifying the regular fulfillment of civil and tax obligations.
The provision of essential personal data referred to in point a) is mandatory for the purposes of fulfilling legal obligations and/or establishing and/or fulfilling the contractual relationship. In the absence of the provision of the data referred to in point a) it will be impossible to establish and/or continue the contractual relationship.
The provision of personal data referred to in point b) is optional and functional to providing a better service to customers. In the event of refusal there will be no consequences.
The personal data concerning the User may be communicated to other companies for the same purposes as above or to external parties specialized in:
- management of software, hardware, telematics and information systems;
- data processing and archiving activities;
- printing, transmission, packaging, transport and sorting of goods to customers;
The processing operations will be carried out both manually and with the aid of computer and telematic means. In fact, the data may be stored both in paper archives and in electronic archives, in order to allow, where necessary, the identification and selection of aggregate data, for a time not exceeding the duration and needs of the processing. The processing will be carried out directly by the owner's organization, with the assistance of its own representatives.
It will take place with logic strictly related to the purposes indicated and with methods that guarantee the security and confidentiality of the data, through the adoption of suitable measures to prevent alteration, cancellation, destruction, unauthorized access or processing not permitted or not compliant with the purposes of the collection.
In order to purchase eyeglasses or sunglasses with prescription lenses, the User must provide the data contained in the medical-ophthalmological prescription, expressly consenting to the processing of sensitive data by Star S.r.l..
If the User sends personal and sensitive data of any third party (purchase of eyeglasses with prescription lenses on behalf of a third party), he/she acknowledges that this operation represents a processing of personal data for which he/she acts as an independent owner, consequently assuming all the obligations and responsibilities provided for by the Privacy Code; in this sense, the User guarantees to Star S.r.l. that any data of third parties indicated by the User (and consequently will be treated by Star S.r.l. as if the third party had provided informed consent to the processing of their personal and sensitive data) has been acquired and processed by the User in compliance with and in accordance with the provisions of the Privacy Code and with the express authorization of the third party; in this sense, the User grants Star S.r.l. the broadest indemnity with respect tod any dispute, claim, request for compensation for damage from processing, which may be received by Star S.r.l. from any interested third party due to the incorrect provision of the data indicated by the User in violation of the rules on the protection of personal and sensitive data.
The User is informed, who by continuing with the purchase accepts that the execution of the contractual relationship involves the transmission of personal data and if applicable also of sensitive data to parties external to Star S.r.l., including the personnel in charge of the company responsible for packaging and shipping (for Users from EU Member States), as well as the personnel in charge of the company responsible for transport and also the personnel in charge of the competent administrative and tax bodies, pursuant to primary or secondary national regulatory requirements and/or the resulting administrative and tax provisions (for Users from non-EU States).
By subscribing to the Newsletter, the User consents to the processing of the personal data provided and authorizes Star S.r.l. to the processing of data for marketing purposes, for sending promotional material and for profiling purposes of products that can be purchased on the chicandclick.com website of Star S.r.l..
